At all relevant times, Merco Construction Engineers, Inc. [hereinafter Merco or Employer] was a public works contractor. On April 6, 2004, the Division of Occupational Safety and Health (Division) opened an accident investigation of Employer. On August 10, 2004, the Division cited Employer for the following alleged violation of the California Code of Regulations1.
