J.F. Shea Construction, Inc. (Employer) is a construction contractor. Beginning May 17, 2006, the Division of Occupational Safety and Health (the Division) through Associate Cal/OSHA Engineer Alvino Aguilera, conducted an accident inspection at a place of employment maintained by Employer at 10505 Garfield Avenue, Fountain Valley, California (the site). On June 16, 2006, the Division cited Employer for an alleged general violation of 1675(j) [failure to secure a portable ladder] of the occupational safety and health standards and orders found in Title 8, California Code of Regulations1, with a proposed penalty of $600.
