On June 8, 2009, the Division issued a citation alleging a violation Title 8 California Code of Regulations section 3210(b) [failure to provide guardrails at an elevated work location] to Employer. Employer timely appealed, asserting various defenses. The matter came on regularly for hearing on October 30, 2009, before an administrative law judge (AU) of the Board. On July 16, 2009, the Division of Occupational Safety and Health (Division) issued citations alleging violations of occupational safety and health standards to Employer. Employer telephoned the Board to initiate its appeal of one of the citation's items (Citation 2, Item 2) on August 18, 2009. On August 24, 2009, the Board sent Employer and the Division letters regarding Employer's appeal. The letter to Employer informed it that the appeal appeared to be late and informed Employer that of the opportunity to provide a declaration establishing that the late appeal was reasonable and for good cause.
